Gather In His Name Terms of Service

Welcome to Gather In His Name! Gather In His Name provides its service to you, subject to the following Terms of Service (TOS), which may be updated or modified periodically without notice to you. You are urged to review the TOS regularly to maintain knowledge of any and all pertinent updates and/or modifications.

1. Eligibility:

You must be eighteen (18) years of age or over to register as a member of Gather In His Name and/or to utilize this site. Membership to Gather In His Name is void where prohibited. By using, maintaining membership, and/or viewing this site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions set forth herein. You also declare that you are at least eighteen (18) years of age or the legal age of majority in AL, MS, NE, WY, and any other location where 18 is not the legal age of majority. Furthermore, you represent that you are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You agree to provide Gather In His Name true, accurate, current, and complete information about yourself as prompted during the registration process. In the event your personal information changes during the course of your membership, you agree to update those changes promptly to keep it true, accurate, current, and complete. Should any of the information you provide Gather In His Name prove to be untrue, inaccurate, not current, or incomplete, your account may be suspended or terminated with no refund. Gather In His Name reserves the right to deny any future service/membership to any person(s) providing any untrue, inaccurate, not current, or incomplete information.

2. Description of Service:

Gather In His Name, hereafter referred to as "The Service", provides members with access to a wide variety of information and resources including, but not limited to, personalized content, communication tools, forums, news, and other miscellaneous content through its network. You understand that membership to The Service may include occasional communications such as announcements, administrative messages, etc. and that these types of communications are considered to be part of your membership to The Service. Any new features or services added to The Service are subject to the TOS unless otherwise stated. You understand and agree that The Service is provided "AS-IS" and "AS AVAILABLE" and that Gather In His Name assumes no responsibility or liability for the delivery, mis-delivery, deletion, timeliness, or failure to store any user communications or personalization settings entered by members/users. You are responsible for obtaining access to The Service which may involve third party fees (i.e. ISP or airtime charges). You are responsible for those fees. In addition, you are also responsible for obtaining, maintaining, and/or using all necessary equipment required to access The Service.

Furthermore, you understand and agree that your use of The Service is at your own risk. Gather In His Name does not guarantee that The Service will meet your requirements or expectations, that The Service will be uninterrupted, error-free, secure, or timely, and that any errors within The Service will be corrected. In addition, Gather In His Name cannot be held liable or responsible for any damage or loss to your computer system or damage or loss of data that may occur during your use of The Service, including but not limited to any downloaded material.

3. Fees/Termination:

Usage and/or subscription fees for The Service were provided to you during the initial registration process. These fees are subject to change with notice to you. Gather In His Name reserves the right to terminate your access, either immediately or with notice, to The Service for any or no reason. Should your membership be terminated by The Service, you will receive electronic notification that will be sent to the email address which you provided either during the initial registration process or the update/change process. If your membership is terminated due to a breach of this Agreement, no refund will be afforded you. Even after this Agreement is terminated, certain provisions will remain in effect. Gather In His Name reserves the right to deny, refuse, and/or terminate membership to The Service for any or no reason at any time. Causes for termination of membership may include but are not limited to: violations and/or breaches of the TOS, or other guidelines, requests by law enforcement or other government agencies, self-initiated deletions/terminations (requests by you), and unexpected technical or security issues/problems.

To cancel your membership/subscription to The Service, contact customerservice@gatherinhisname.com. In the event that you cancel your membership prior to the next billing date, you understand and agree that your access to The Service will not be affected until the cancellation occurs on the next billing date.

In the unfortunate event of death of a member/user, that membership (including user ID and all content) will be terminated upon proper notification to customerservice@gatherinhisname.com. Memberships to The Service are non-transferable and no "rights of survivorship" are offered.

5. Security, Password, Member Account:

Upon completion of the initial registration process, you will choose a user ID and password. You are solely responsible for maintaining the security and confidentiality of that information. You agree that you are fully responsible and liable for all activities that occur under your password/account. You agree to notify The Service immediately in the event that your password has been lost, stolen, or misused. You also agree to notify The Service immediately if there has been a breach in security of any kind. You agree to exit from your account upon completion of each session. Gather In His Name cannot and will not be held responsible or liable for any loss or damage which occurs from your failure to comply with this section.

6. Member Conduct:

You understand that all information, messages, postings, photographs, text, and data or other materials (content), either posted publicly or transmitted privately, are the sole responsibility of the person from which said material originated. You are responsible and liable for all material (content) that you upload, post, transmit, display, or otherwise make available through The Service. While Gather In His Name does monitor some content, The Service cannot and will not be held liable or responsible for and does not guarantee the accuracy, integrity, or quality of the content posted to The Service. Furthermore, under no circumstance is Gather In His Name responsible or liable for any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content uploaded, posted, emailed, transmitted or otherwise made available through The Service.

Gather In His Name is a service provided based on the Beliefs, Morals, Values and Teachings of The Bible. We are a Christian organization and pride ourselves on behaving as such. As a member/user, you do NOT have to be a Christian or base your lifestyle/beliefs on The Bible as we do. However, as a member/user you DO have to abide by and agree to the following rules: You agree that you will be respectful of the opinions/beliefs of other members/users. You agree that you will NOT harass, incite, intimidate, insult, belittle, threaten, harm, or otherwise negatively impact another member/user or the general membership. Sexually explicit content or implications are not allowed under any circumstances. While discussions on opinions and beliefs are encouraged, you must remember that The Service is inter-denominational and differing beliefs/opinions will be present. We expect all members/users to conduct themselves in a respectful and appropriate manner. Gather In His Name reserves the right to make final decisions regarding offensive/inappropriate content or the appearance of such. Furthermore, Gather In His Name reserves the right to make determinations on what content is inappropriate and/or offensive. In addition, we reserve the right to make determinations regarding corrective measures, up to and including membership termination (without refund) in order to remedy a violation of the TOS. While The Service may provide warnings in some instances, we resave the right to terminate or cancel the membership (with no refund) of any user/member in violation of the TOS based on any content/material deemed inappropriate/offensive by Gather In His Name.

In addition, you agree not to use The Service to:

  • upload, post, transmit, display or otherwise make available any content that is unlawful, harmful, threatening, harassing, abusive, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable.
  • impersonate any person or entity, including but not limited to any Gather In His Name official, host, moderator or guide, or falsely state or otherwise misrepresent yourself in any way.
  • upload, post, transmit, display or otherwise make available any material or content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  • violate any local, state, federal, or international law either intentionally or unintentionally.
  • disrupt or interfere with The Service, including connected networks and servers, or to disobey any requirements, procedures, policies, or regulations of networks connected to The Service.
  • collect and/or store personal information about other users/members.
  • disrupt or interfere with the normal flow of dialogue within the chat room(s), including but not limited to causing the screen to "scroll" faster than a reasonable person is able to type or follow, and/or to negatively affect other members/users causing their experience to be diminished.
  • upload, post, transmit, display or otherwise make available any material or content that violates or infringes on any patent, trademark, trade secret, copyright or other proprietary rights of any party, and/or any content that you do not have a right to upload, post, transmit, display or otherwise make available under any law or agreement, including but not limited to confidential information gained as part of employment.
  • upload, post, transmit, display or otherwise make available any material or content that is unsolicited or unauthorized advertising, 'spam', 'junk mail', 'chain letters', 'pyramid schemes', or any other form of solicitation.
  • reproduce, duplicate, copy, sell, trade, resell, or exploit for any purpose, commercial or noncommercial, any part of The Service, including but not limited to your connection to, your use of, and/or your access to The Service.

You agree that you will not utilize any robot, spider, or any other automatic device/manual process to monitor and/or copy our web pages or any content contained within them. Furthermore, you agree that you will not use any device or software to bypass or to interfere or attempt to interfere with the proper working or functionality of this site. You agree that you will not take any action that will impose any unreasonable strain on our infrastructure and/or networking capabilities.

You understand and agree that Gather In His Name reserves the discretionary right to remove and/or delete any and/or all content deemed inappropriate and/or found to be in violation of the TOS. You understand and agree that you are solely responsible and bear all liability associated with the uploading, posting, transmittal, display or otherwise made available content/material. You understand and agree that you are responsible and liable for the accuracy, completeness, and/or usefulness of such content/material.

You understand, agree and consent that The Service may disclose any and/or all personal information and/or content required to either comply with the legal process, enforce the TOS, respond to claims that the information/content violates the rights of a third-party, respond to your request(s) for customer service, or protect the safety, rights, interests, or property of Gather In His Name, its users/members and/or the general public.

You understand and agree that the technical processing and transmission of The Service, which includes your content/material, may be transmitted over various networks and be changed/conformed to adapt to the technical requirements of connecting networks and/or devices.

You understand, consent and agree that Gather In His Name is in NO way responsible or liable for any activity that occurs outside the confines of The Service. In the event that members/users agree to meet in person, share telephone conversations, share email conversations, share chatroom/message conversations or otherwise contact one another outside The Service, Gather In His Name is neither liable nor responsible for any loss or damage, actual or consequential, of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such contact/meeting.

7. Member Disputes:

In the unfortunate event that you find another member/user to be in violation of the TOS either intentionally on unintentionally, please email us at abuse@gatherinhisname.com. Furthermore, should you find content that appears to be offensive, harmful, inaccurate, or deceptive, please email us at abuse@gatherinhisname.com. You understand and agree that Gather In His Name, its owners, employees, and/or affiliates, are neither responsible nor liable for any damages, actual and/or consequential, of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

8. International Use:

You understand and agree to comply with any and all local rules regarding online conduct and the guidelines of acceptable content. Furthermore, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside. Gather In His Name neither holds nor accepts responsibility or liability for your compliance to these laws/regulations or lack thereof.

9. Content Made Available:

Gather In His Name does not claim ownership to content/material you upload, post, transmit, display or otherwise make available for display on The Service. However, regarding content/material you submit for display in publicly accessible areas, you agree that Gather In His Name has the following non-exclusive, world-wide, royalty free license(s) as applicable:

You agree to afford Gather In His Name the license to distribute, use, reproduce, adapt, modify, publicly display and/or publicly perform content that you submit for public access for either as long as you elect to include such content/material in the publicly accessible area or as long as The Service elects to display said content/material in the publicly accessible area. Such license will expire upon deletion/removal of said content/material either by you or by The Service.

You agree to afford Gather In His Name the license to distribute, use, reproduce, adapt, modify, publicly display and/or publicly perform photos and/or graphics that you submit for public access for either as long as you elect to include such item(s) in the publicly accessible area or as long as The Service elects to display said item(s) in the publicly accessible area. Such license will expire upon deletion/removal of said item(s) either by you or by The Service.

10. Indemnity:

You agree and consent to hold Gather In His Name, its owners, agents, employees, and affiliates harmless from any and all claims and/or demands, including reasonable attorneys' fees, made by any third party due to or as a result of any content/material you upload, post, transmit, display, or otherwise make available through The Service, your use of The Service, your connection to The Service, your violation of the TOS, your violation of any and/or all rules, regulations or laws (local, federal, or international) and/or your violation of any rights of another.

11. Non-Commercial Use:

The Service is for the personal use of individual members only and may not be used in connection with any commercial endeavors whatsoever. Businesses, organizations, companies, and/or any other entity of the like may not become members/users of The Service. Furthermore, businesses, organizations, companies, and/or any other entity of the like may not utilize The Service for any purpose including, but not limited to: sending unsolicited email to members/users, transmitting commercial advertisements for other web sites or services anywhere on The Service (including, but not limited to chat room areas and discussion boards), and/or utilizing member/user information for any purpose. Unauthorized use of The Service will be investigated and appropriate legal action will be taken, including, but not limited to civil, criminal, and injunctive redress and/or termination of membership with no refund at the sole discretion of Gather In His Name.

12. Use And Storage:

You understand and agree that The Service may establish limitations regarding the use of The Service, including but not limited to the maximum number of days messages, postings, and/or other content/material will be retained and/or made available. Furthermore, guidelines may be imposed regarding the size, number, and/or amount of information/content that may be uploaded, posted, transmitted, displayed or otherwise made available through The Service. In addition, other limitations and/or guidelines may be in place for the following: the maximum number of times you may access The Service at any given time, the maximum amount of disk space that will be allotted on the servers for you, and the maximum number of times you may send/receive messages. You agree that Gather In His Name is neither responsible nor liable for the deletion, retraction, or failure to store any message, posting, and/or any other form of content/material (including communications) maintained or transmitted by The Service. You further understand and agree that Gather In His Name reserves the right to log off accounts that are or have been inactive for an extended period of time (to be determined at the discretion of The Service).

13. Modifications:

Gather In His Name reserves the right to change, discontinue, or add (either temporarily or permanently) The Service or any portion of The Service with or without notice to you. You understand and agree that Gather In His Name cannot be held liable or responsible to you for any such changes, deletions or additions of The Service or any portion of The Service.

14. Advertisers:

You understand and agree that Gather In His Name is neither responsible nor liable for any loss or damage of any sort incurred as a result of your correspondence or dealings with, or any participation in promotions of advertisers found either on or through The Service. Furthermore, Gather In His Name is neither responsible nor liable for any loss or damage incurred as a result of the presence of any third-party advertisers on The Service.

16. Statute of Limitations:

You understand and agree that any claim or action arising out of or related to The Service must be filed within one (1) year after such claim or action occurred or be forever barred, regardless of any other statute or law to the contrary.

17. Violations:

Please report any and all violations of the TOS to customerservice@gatherinhisname.com or abuse@gatherinhisname.com.

18. Waiver:

In the event that Gather In His Name does not enforce or exercise any right, provision or portion of the TOS, you understand that it does not constitute a waiver of said right, provision or portion.

The Section titles in the Terms of Service are for your convenience only and have no legal or contractual effect. Furthermore, the order in which each section is placed has no bearing or implication on the level of its importance.
